HEMERA FOUNDATION CONTEMPLATIVE FELLOWSHIP
RELEASE OF LIABILITY AND WAIVER OF CLAIMS
The undersigned is applying for a Hemera Foundation Contemplative Fellowship Grant (the “Fellowship”) to fund his or her participation in a retreat (the “Retreat”) at the retreat center to which he or she is applying (the “Retreat Center.”). The Fellowship is funded by Hemera Foundation and administered by Hemera Regnant, LLC.
If I am awarded a Fellowship to participate in the Retreat, as a condition of my receipt of the Fellowship, and for other good and valuable consideration, the sufficiency of which is hereby acknowledged, I hereby consent and agree to the following terms (hereafter referred to as this “Release”):
I acknowledge there may be risks, including without limitation injury, illness or death, associated with my participation in the Retreat. I hereby knowingly and willingly assume any and all such risks (whether or not foreseeable). I will comply with any and all policies, rules, standards, instructions, and guidelines relating to safety or conduct provided to me during my participation in the Retreat.
I (on behalf of myself and expressly intending to bind my survivors, heirs, estate, executors, representatives, administrators and assigns) hereby irrevocably and unconditionally: (A) indemnify, release and hold harmless Hemera Foundation, Hemera Regnant, LLC, each of their affiliates, and all officers, trustees, directors, employees, agents, representatives, assigns, successors and contractors of each such entity, whether past, present or future, and each of them (collectively, “Hemera”) for and from any and all claims, actions, damages, losses, liabilities, costs and expenses of any nature (including without limitation those relating to personal injury, property loss or damage, and/or death) arising out of or in any way relating to my participation in the Retreat (collectively referred to herein as “Claims”); and (B) waive all rights and Claims, and agree not to assert the same, against Hemera.
I expressly acknowledge that: (A) to the fullest extent permitted by law, the term of this Release intended to and will apply whether or not Hemera or the Retreat Center is wholly or partially negligent or otherwise at fault, and (B) this Release constitutes a complete, perpetual and unconditional release, discharge, and waiver of any and all Claims against Hemera.
I acknowledge that I have been given an opportunity to read and understand this Release, I have sought and obtained any information I feel necessary and appropriate, and I enter into this Release knowingly and voluntarily. This Release represents my complete understanding with Hemera concerning Hemera’s responsibility and liability for my participation in Retreat and supersedes any other understandings (whether oral or written) I may have had with Hemera regarding its subject matter. This Release is intended to be as broad and inclusive as permitted by law and will continue in full force and effect even after the completion of the Fellowship. If any portion of this Release is held invalid, the balance of this agreement shall continue in full force and legal effect and I agree, if requested by Hemera, to execute a new release and waiver of claims that is valid and enforceable. This Release shall be construed and enforced by the laws of Colorado.
For the avoidance of doubt, this Release becomes effective upon my acceptance of a Fellowship.
BY SIGNING THIS RELEASE, I UNDERSTAND THAT I AM WAIVING OR RELEASING VALUABLE LEGAL RIGHTS IN THE EVENT I AM AWARDED A FELLOWSHIP TO PARTICIPATE IN THE RETREAT. I have read, understand and agree to the terms of this Release.
